Nnamdi Kanu’s Lawyer Cries Out Over His Client’s Treatment In DSS Custody

Ifeanyi Ejiofor, lawyer to the embattled leader of the proscribed Indigenous People of Biafra (IPOB), Nnamdi Kanu, has accused the Department of State Service (DSS) of denying his client maximum possible comfort as directed by the court.

Ejiofor made the accusation in a statement was titled, ‘Update On Today’s Visit To Our Indefatigable Client – Onyendu Mazi Nnamdi Kanu At The Headquarters Of The Department Of State Services (DSS) Abuja’.

Naija News reports that Justice Binta Nyako of the Federal High Court in Abuja on December 2, 2021, ordered the secret police to allow Kanu to practice his faith, change his clothes, among other things while in custody.

After delivering the ruling, Justice Nyako adjourned the trial of the IPOB leader till January 18, 2022.

CHECK THIS:  Meet Nigerian Governor Who ‘Doesn’t Talk, Can Sit With You 10 Days Without Speaking’

He stated that the continuous disobedience of court orders by the DSS is becoming worrisome, asking the judiciary to address the ugly trend.

Ejiofor submitted that his routine visit to Kanu in DSS custody on Monday reveals that his client has been denied his medical report after taking his blood more than 21 times.

He wrote, “We were informed by our client – Onyendu Mazi Nnamdi Kanu that none of the pronouncement made by the Court on the 2nd of December 2021 has been obeyed by the lawless DSS. They have unrepentantly continued to treat the Orders of the Court with the greatest disdain.

“Our client – Onyendu Mazi Nnamdi Kanu further informed us that he had not eaten anything since Sunday, apparently being punished because we dared to complain to the court about the harsh condition under which he is being held in custody. But, very, unfortunately, this should be the height of their reckless affront to the orders of the court.

“At the time Her Lordship made these far-reaching orders in open court, I did not mince words in bringing to the attention of the court that the operatives of the DSS will flout these orders, pursuant to which the court specifically directed me to come back to her with these facts if her order is flouted by the detaining authority.

The detaining authority (DSS) is an Agency clearly established by instrumentality of the laws and should operate within the confines of the same laws establishing them, and should not be seen as a lawless entity, which unfortunately is what they represent in practice.”

Ejiofor vowed to approach the court immediately with the development, stating that Kanu has not been convicted of any crime.

Breaking: Dowen College Parents Demand Change Of School Management

The parents’ forum in the statement signed by Aituaz Kola-Oladejo, Waheed Adeoye, Oluwaseun Bolanle Ajila and Kingsley Kema Agu said a candlelight procession would be held for Sylvester on Wednesday.

According to the parents, what happened to Sylvester “could have happened to any other child in the school.”

“We urge the school management team and other stakeholders (students and parents directly or indirectly mentioned) to fully cooperate with the authority in the ongoing investigation. While we would have loved to bring Sylvester back if humanly possible, unravelling the cause of Sylvester’s death and bringing whoever was responsible or might have contributed in whatever way to book, will not only bring this unfortunate incident to closure for the family, but this will also serve as a deterrent to others in all schools in Nigeria.

“We, therefore, say justice for Sylvester, is justice for all. On our part as parents, we will work more closely with the school (management/board), to ensure necessary measures are put in place to prevent a reoccurrence of this unfortunate incident and stamp out bullying in any form from the school.

“We therefore earnestly ask for a resolution that will bring some relief to the bereaved family, other parents, students of Dowen College and the public.

“These should include a change of the school management and hostel teachers, installation of CCTV cameras in all strategic places and overhauling of the school security system.

“The Parents’ Forum is organising a Candle Light event. Details of which are as follow: Wednesday, December 8, 6 pm; Dowen College. The lighting of candles is to pay tribute to a life ‘passed’ and keeping the light burning signifies that the memory still lives on and burns bright.”

“2. Because my son is a day student, he was not on the school premises at the time when the unfortunate incident occurred, precisely on the night of 21st November 2021, during a weekend and so, could not have been in the hostel as alleged.

“3. In a social media post made on 1st November 2021, on the deceased’s elder brother’s Instagram page, “greatoromonii”, five names, including Dowen College were mentioned before the conclusion: “… just know he called your names before he died”. My son’s name was not among those names.

Seven Boko Haram Suspects Released From Police Custody

Borno State Command of the Nigerian Police Force has set free seven Boko Haram suspects in its custody.

Their release, Naija News understands was coming barely a week after an order for their release was issued by the Federal High Court, Abuja.

The court judge, Justice Modupe Olajuwon had on December 1 asked the security forces to release the terrorist suspects declaring that their detention was illegal.

The seven detainees are understood to have spent three years in the police net following their arrest in Maiduguri, Borno state capital.

Legal Counsel to the suspects, Peter Abbo had in a suit argued a fundamental human rights enforcement on his clients.

Ruling in favour of the suspects, Justice Olajuwon asked the Police Force to release them all, while ordering that the sum of N15 million should be paid to the seven over their unlawful detention for three years without trial.

The suspects, who were said to have been arrested inside a Maiduguri market, were allegedly dumped at the Special Anti-Robbery Squad (SARS) detention facility at Abbatoir in Abuja.

CHECK THIS:  Video Of Kpokpogri Being Released From Detention Surfaces After His Denial

Justice Olajuwon, in the judgment on their fundamental human rights enforcement suit, had held that the detention of the men for three years without trial contravened the provisions of the 1999 constitution.

The judge had said that the police acted in bad faith in keeping the detainees beyond the period required by law especially when there was no cogent and verifiable ground of indictment of the applicants for any offence.

Justice Olajuwon, while holding that the detention was illegal, unlawful and unconstitutional, consequently ordered that the seven applicants be released forthwith to their families.

The judge ordered that each applicant be paid a sum of N2 million as damages for their unlawful detention and another N1 million as the cost of litigation that brought about the judgment.

Counsel to the applicants, Aboh, while confirming the release, told our correspondent that the detainees have just been handed over to him and that they are eager to go back to Maiduguri to reunite with their families after three years of separation.

As I am talking to you, the seven detainees are here with me having just been released on the order of the federal high court in Abuja issued on December 1.

“Though their detention is arbitrary, unjust and unlawful, they are still happy that police complied with the order of the court and they are in high spirits seeking to travel immediately to Maiduguri where they were arrested,” he said.

He insisted that the detainees were unjustly labelled as Boko Haram suspects by police to justify the unlawful detention.

The applicants Naija News understands are Ajiri Bulama Dungus, Gudja Giddah, Adam Mohammed, Wardi Dungus, Fanami Mustapha, Mohammed Abba and Makinka Alhaji Dungus.
